These Terms of Use ("Terms") govern your use of the AgWise farm management application ("App") operated by Prairie Nomad Technologies ("we," "our," or "us"). By downloading, installing, or using AgWise, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
AgWise is a farm management application designed for Canadian prairie farmers. The App provides tools for tracking fields, grain bins, equipment, spray logs, grain contracts, yield records, cost of production, and AI-powered farm recommendations.
To use AgWise, you must create an account using your phone number. You agree to:
You must be at least 13 years of age to create an account.
You may sign in using your registered phone number or email address. Email sign-in requires verification of your registered phone number for security purposes.
The Free plan provides limited access to AgWise features including basic field tracking (up to 5 fields), weather forecasts, and basic bin tracking.
The Pro plan is available for CAD $1,499 per year or CAD $129 per month and provides full access to all AgWise features including unlimited fields, equipment tracking, grain contracts, yield records, cost of production, AI Advisor, data backup and sync, and all reports.
Pro plan subscriptions are billed annually or monthly through the Apple App Store. Payments are processed by Apple, Inc. in accordance with their terms and conditions. We do not store your payment information.
You may cancel your Pro subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. Refunds are subject to Apple's refund policy.
If your Pro subscription expires or is cancelled, your account will revert to the Free plan. Your data will be retained but editing and adding new entries beyond Free plan limits will be restricted. You will retain read-only access to all previously entered data.
The AgWise AI Advisor uses artificial intelligence to analyze your farm data and generate recommendations. These recommendations are generated automatically by the Anthropic Claude AI model and are provided for informational purposes only.
AI recommendations generated by AgWise are NOT:
Before making significant financial decisions, seeding decisions, pesticide applications, or grain marketing decisions, you should consult with qualified professionals including certified agronomists, financial advisors, and grain marketing specialists.
Artificial intelligence systems, including the Claude AI model used by AgWise, can and do make errors. AI recommendations may be:
We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of AI-generated recommendations.
PRAIRIE NOMAD TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR COSTS ARISING FROM YOUR RELIANCE ON AI-GENERATED RECOMMENDATIONS, INCLUDING BUT NOT LIMITED TO:
YOUR USE OF THE AI ADVISOR FEATURE IS AT YOUR OWN RISK.
The AI Advisor feature is powered by Anthropic, PBC. When you use the AI Advisor, your farm data is transmitted to Anthropic's servers for processing. By using the AI Advisor, you agree to Anthropic's Terms of Service and Privacy Policy.
We are not responsible for Anthropic's actions, data practices, or service availability. The AI Advisor feature may be unavailable if Anthropic's services are offline.
Weather data displayed in AgWise is provided by Open-Meteo and is for general informational purposes only. Weather forecasts may be inaccurate, incomplete, or outdated. Do not rely on AgWise weather data for critical agricultural or safety decisions. We are not responsible for any losses arising from reliance on weather information displayed in the App.
You agree not to:
AgWise and all related content, features, and functionality are owned by Prairie Nomad Technologies and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
You retain ownership of all farm data you enter into AgWise. By using the App, you grant us a limited license to store and process your data solely for the purpose of providing the AgWise service.
Your use of AgWise is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices, including how your data is used by our AI features.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRAIRIE NOMAD TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, CROP LOSSES, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Prairie Nomad Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.
You may delete your account at any time through the More section of the App. Upon deletion, your data will be retained for 30 days to allow for account recovery, after which it will be permanently deleted. Deleting your account does not entitle you to a refund of any subscription fees paid.
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or via SMS or email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Saskatchewan, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
